Bids for our Online Auctions may only be placed online over the Internet. No phone bids will be accepted, nor will there be a live auction for these properties.
Buyers must be registered to bid. Registration is free. Please click on the "How to Register" link above.
Bids will display on the auction page immediately. If you have placed a bid, and are "out-bid" by another bidder, you will receive an Email notification from us that you have been out-bid, the amount of the new bid, as well as the minimum amount you would need to raise the current bid.
A bid by any person shall be conclusive proof that the bidder understands and accepts these terms of sale and agrees to be bound by them. Auctioneer reserves the right to reject any bid he deems unresponsive. Properties are offered under “Exclusive Right of Sale” by John Bickel & Associates.
These are "Auctions with Reserve," and the "Reserve Price" is always unannounced and unpublished in advance.
We use two different forms of Reserve Auctions:
One, the "Reserve Price" has been agreed to by the Seller in advance and is entered invisibly into the system.
Two, the Seller has not preset a specific "Reserve Price," and the final high bid is "Subject to Confirmation" by the Seller.
If the "Reserve Price" has been agreed to in advance by the Seller, the listing will show "Reserve not met" until the bidding reaches or exceeds the "Reserve Price." Once met, the listing will show "Reserve met." When this notation appears on the listing, bidders know that the property IS going to sell to the highest bidder at the close of bidding.
If the listing shows nothing about a "Reserve Price," then the "High Bid" is "Subject to Confirmation" by the Seller, and may or not be accepted by the Seller.
Please do not hesitate to bid! We coordinate with Sellers to establish what we believe to be a reasonable "Reserve Price" under the present market conditions. The "Reserve Price" is set solely to protect the Seller from ridiculously low bids.
Each auction has a "Starting Time" and an "Ending Time." Auctions start as soon as the property appears on our website. You may bid on any property up till the posted "Ending Time." Note that when multiple properties are listed, the "Ending Times" are staggered by several minutes to simulate a live auction. Therefore, if you are outbid on a property, you still have a chance to bid on other properties before the entire auction closes.
The High Bidder will show on each lot immediately following the close of the auction, along with the final "High Bid."
If you are the "High Bidder" at the close of bidding on a listing showing "Reserve met," you will receive an email notification of your winning bid and you acknowledge having created a non-cancelable contract of sale.
If you are the "High Bidder" at the close of bidding on a "Subject to Confirmation" listing, Sellers have 48 hours to either accept or reject your bid, and you will promptly receive an email from us notifying you of the Seller's response. Bidders acknowledge that Seller acceptance (confirmation) constitutes a non-cancelable contract of sale.
Bids may not be withdrawn or modified once they are entered into the system.
All property is sold “AS-IS, WHERE-IS.”
All sales are final either when "Reserve Price" is met, or upon confirmation of the "High Bid" by the Seller.
All successful transactions will be immediately forwarded to Aaccurate Title Services of SWFL, LLC, 403 Joan Ave. N., Suite B, Lehigh Acres, FL 33971, Phone: 239-369-0363, Fax: 239-369-0364, for processing and final settlement. Expect to be contacted by them via phone or email.
Transfer of title is by Warranty Deed (the best) free and clear of all liens and encumbrances with full Title Insurance.
A deposit of 10% of the "High Bid" must be delivered to the Title Company within three business days. Closings can be handled by mail. It is not necessary to appear in person at Aaccurate Title. Auction sales are cash. No contingencies for financing or inspection or for any other reason. Time is of the essence. Non-performance by buyer could result in loss of deposit as liquidated damages.
John Bickel & Associates makes no representations about the properties offered including condition, actual size, zoning, or suitability for the buyer’s purpose. Information on these properties has been obtained from the public records and is believed to be reliable as presented, but not guaranteed. Buyers shall rely on their own judgment, information, and inspections of the properties. No further information on individual properties is available from the auctioneers.
Full cash payment is due within 15 days of seller acceptance. No exceptions for any reason. All normal closing costs including transfer tax, title insurance, processing and recording fees, and a 10% Buyer Premium will be paid by Buyer ("High Bidder"). Current year property taxes will be prorated to closing date.
