Answer: Here's how bidding works on our system! It's an "online, real time" format. When you place a bid, you enter the maximum amount you're willing to pay for the property. The seller and other bidders won't know your maximum bid amount. Our system places bids on your behalf starting with the next bid increment for the property. It will bid as much as necessary to make sure that you remain the high bidder (or to meet the reserve price, if there is one). It will keep bidding for you until bidding reaches your maximum amount. If another bidder has placed the same bid before you or a higher maximum bid, the system will let you know that you've been outbid so that you can place another bid if you want. However, if no other bidder has a higher maximum bid at the end of the auction, you are the winner even if your bid doesn't go as high as your maximum bid. You could pay significantly less than your maximum price. This means you don't have to keep coming back to re-bid every time another bid is placed. You won't necessarily pay the amount of your maximum bid. Our system will increase your bid on your behalf, using only as much of your bid as is necessary to maintain your high bid position. Your maximum bid is kept confidential (until it is exceeded by another bidder). Important Notes: In Reserve Price Auctions, if your maximum bid is the first to be greater than the seller's reserve price, our system will automatically jump the price up to meet the reserve, and bidding will continue from there. Please make sure you have read all of the "Auction Terms" of each auction before bidding. Watch the property listing to monitor the bidding. You may be outbid, especially near the end of the auction. The auction bidding information will update automatically as new bids come in (no need to refresh your browser window) Any bids coming in near the listed closing time will automatically extend the closing time briefly to make sure that all bids are received. When the auction closes, if you are the "High Bidder," you will receive an Email from us verifying your successful bid!

Terms

 

  1. To bid on our property, you must be of legal age to enter into contract to purchase real estate (18 in most states, 21 in others). If you're in doubt about the legal age to enter into contract in your state, please consult with competent legal counsel before bidding.
  2. While auction is "active", all bids MUST be placed online. 
  3. Winning bid is subject to seller approval.
  4. Buyers Agent commission of 3% is being offered.
  5. All bids are placed in US Dollars.
  6. If you are outbid by another bidder, you will receive an email notice so you can return and increase your bid if you so desire.
  7. The bidding will be open and everyone will have access to the bid history during the auction.
  8. As the auction nears the ending time it will auto-extend until bidding is silent for 2 minutes.
  9. If there is more than one high bid at the same level (a tying bid), the bid first submitted will be honored.
  10. Winning bidder has the option to have a proxy bid, have phone bid, or attend live auction to bid on property the following day.
  11. Seller reserves the right to postpone or cancel this auction at any time for any reason, before the online auction ends. 
  12. Sale is “as-is”, "where-is". Seller will not fix anything.
  13. Within 1 day of auction close, winning bidder will be asked to obtain loan pre-approval or show proof of funds and sign a sales contract at the winning bid amount and based on the terms described here.
  14. Closing will take place at seller's and winning bidder's agreed upon title company within 30 days of signing the contract.
  15. When contract is signed, winning bidder will pay $10,000 non-refundable down payment to be held at title company handling the closing. The remaining balance will be paid at closing.
  16. Winning bidder may, at their option and expense order a title examination and insurance.
  17. Seller will include the following personal property in the sale: None
  18. Seller will exclude the following real property from the sale: None
  19. Auctioneer is a licensed real estate agent in the State of Arkansas.
  20. Live auction will begin 24 hours after online auction ends. 
  21. Highest bidder will be the opening bid on the day of the live auction.
  22. Announcements made on the day of the Live Auction will supersede any advertised material.
Buyer Premium: 5.0%
This fee is added to the winning bid amount and is paid by the Buyer. High Bid + Buyer Premium = Selling Price.
