3. While auction is "active", all bids MUST be placed online.  Written offers will not be accepted.
4. Highest bid is subject to seller approval.

7. There is a 2% buyer's premium charged  to the winning bidder.
8. All bids are placed in US Dollars.  Cash Only offers will be accepted.
9. If you are outbid by another bidder, you will receive an email notice so you can return and increase your bid if you so desire.
10. All bids are irrevocable by the bidder.  The property will be sold to the highest bidder subject to seller's confirmation and approval.
11. The bidding will be open and everyone will have access to the bid history during the auction.
12. As the auction nears the ending time it will auto-extend until bidding is silent for 2 minutes.
13. If there is more than one high bid at the same level (a tying bid), the bid first submitted will be honored.
14. The high bidder will be notified via email after the auction ends.
15. Seller reserves the right to postpone or cancel this auction at any time for any reason.
16. Sale is “As Is”, "where-is". Seller will not fix anything.  Each bidder acknowledges that it is their responsibility to inspect the property prior to placing a bid in order to determine its suitablity for their intended use.  No inspection contingency will be considered in any purchase agreement for Auction property.
17. Within 1 day of auction close, winning bidder will be asked to show Proof of Funds in the amount equal to or greater than the final purchase price (winning bid price + 2% buyer's premium) and sign an "As Is" sales contract for the final purchase price (winning bid price + 2% buyer's premium)  based on the terms described here.
18. Real Estate Broker shall immediately contact the winning bidder upon conclusion of the auction.  The winning bidder becomes the Buyer.  If no Buyer Agent has previously registered the Buyer, the Real Estate Broker shall become the Buyer's agent.
19. We welcome Buyer/Referral Agent participation.  A Buyer Agent shall be a Florida licensed real estate agent who has registered their customer in writing on a form approved by Real Estate Broker prior to customer's initial auction registration.  At closing, the Buyer agent shall be paid the amount offered in the MLS as the Buyer Agent/Transaction Broker Compensation and the Real Estate Listing Broker shall be paid the Buyer Premium collected from the Buyer at closing.  The Referral Fee will be paid to licensed real estate agent equal to 25% of the buyer Broker compensation offered in the MLS provided referring agent has registered their customer before customer's initial auction registration for this property.
20. Upon notification, Buyer agrees to promptly enter into a standard Florida Residential Real Estate "As Is" contract.  As part of the contract, Buyer agrees to:
    1. Deposit $10,000 earnest money to be held by the Title Company of Seller's choosing within 3 days of the effective date (signing of As Is Contract).
    2. Closing will take place at the Title Company designated by the listing agent within 30 days of signing the contract.
